Are my partner and I eligible for maternity/paternity leave?
You are eligible for maternity/paternity benefits if you have been employed for at least 13 weeks, and for at least 120 hours, before you go on your leave.
Length of maternity/paternity leave
Parents have the right to a total of 52 weeks leave with maternity leave benefits.
The mother is entitled to 4 weeks' maternity leave (barselsorlov) prior to giving birth and 14 weeks after.
The father is entitled to 2 weeks' leave after the birth, and the remaining time can be divided between the parents according to individual wishes.
If you work in the public sector
Public sector employees receive full salary during maternity leave.
If you work in the private sector
Private sector employees are entitled to a minimum level of maternity benefit, which is subject to negotiation with the employer.
Parents who are not entitled to paid maternity leave from their workplace can receive maternity maintenance from their municipal office in their place of residence. In order to claim this payment, contact the local municipality no later than eight weeks after the birth.
How to plan the maternity/paternity leave
No later than 3 months before the expected birth, you have to inform your employer when you plan to take your leave. As a father to be, you have to inform your employer no later than 4 weeks before your expect to take your paternity leave, when you wish to take your 2 weeks of leave.
Your employer will apply for you
You have to ask your employer to apply for your maternity/paternity benefits through NemRefusion. Subsequently, you will receive a letter of notification from Udbetaling Danmark asking you to fill out a form with additional information, which you have to return.
If you or the child’s other parent is not subject to the Danish maternity/paternity rules before your child is 46 weeks, you cannot take your leave and receive maternity/paternity benefits from Udbetaling Danmark later on.
